This presentation focuses on the various contract clauses found in virtually every construction subcontract and prime contract which create risks for electrical contractors. These provisions, such as condition precedent payment clauses, no damage for delay clauses, and indemnity clauses, pose significant risks to the subcontractor. The subcontractor must be familiar with these risks in order to both negotiate better subcontract language and manage the risks during performance. Each subcontract risk provision requires a different approach to managing the risk. The class will review exceptions, loopholes and other ways to minimize, if not avoid, the risks entirely. Attendees should leave the program better equipped to negotiate their next subcontract and administer their next project.
